The Petitioner apprehends his arrest in Teghra P.S. Case No.83 of 2016 instituted for the offence under Section(s) 498-A, 304-B/34 Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act, pending in the Court of the Chief Judicial Magistrate, Begusarai.
Petitioner is husband of the deceased. There is allegation that the deceased was married about two years ago. She was tortured for demand of dowry and the informant got information on telephone that his daughter has been burnt. The informant went to Sasural of the daughter and took her to Primary Health Centre, Teghra, but she died in the way.
Patna High Court Cr.Misc. No.6792 of 2017 (4) dt.24-03-2017 2/2 Case diary has been received.
Learned APP has submitted that the witnesses have stated in the case diary that the petitioner used to assault his wife (deceased) after taking alcoholic drink. It has further been submitted that in the Post Mortem Report the doctor has opined the cause of death due to burn injury.
In this manner, it appears that unnatural death of the deceased has occurred within two years of marriage in her Sasural.
In view of such, this Court does not find it a fit case for grant of anticipatory bail.
Prayer is rejected.
The petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
