The petitioner seeks bail in connection with Harsidhi P.S. Case No. 329 of 2018 instituted for the offence under Section(s) 25 (1-b), a, 26, 35 of the Arms Act. It is alleged in the written report that police got information that some miscreants were planning to commit dacoity in the house of Tuntun Singh and police reached near the house of Tuntun Singh. Thereafter, miscreants after seeing the police party started running away. Police, on chase, apprehended eight accused persons which included this petitioner. Thereafter on search, one carbine, two magazine and 9 cartridges have been recovered from the bag of co-accused Alok Tiwri, one loaded country made pistol has been recovered

Patna High Court Cr.Misc. No.70753 of 2018(2) dt.03-12-2018 2/2 from possession of co-accused Prakash Sah.

Learned counsel for the petitioner has submitted that there is no recovery of any incrimination article from the possession of this petitioner.

Petitioner is in custody since 11.08.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, at Motihari in connection with Harsidhi P.S. Case No. 329 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
