The trial court has reported that prosecution has already completed its evidence and when the matter was pending for defence evidence, a petition was filed on behalf of the defence under Section 311 of the Cr.P.C. to recall some prosecution witnesses, which was rejected by the trial court and against the aforesaid rejection order, the defence sought adjournment for filing a petition before this Court. The trial court has observed that the delay in disposal of the trial of the petitioner is due to non cooperation of defence. In view of the aforesaid report as well as submissions of the parties, this petition for bail of the petitioner in connection
Patna High Court Cr.Misc. No.42022 of 2016 (3) dt.16-11-2016 2/2 with Sessions Trial No.24/8 of 20114, arising out of Bhagwanpur P.S. Case No.102 of 2013 pending in the court of Additional Sessions Judge-I, Kaimur, Bhabhua, is again rejected. However, the trial court must conclude the trial of the petitioner within a month from the date of receipt/production of a copy of this order, if further proceeding of trial is not stayed by any observation of this Court. It is made clear that if trial court fails to conclude the trial of the petitioner within the above stated period, petitioner may renew his prayer for bail before the learned trial court itself.
