JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 12-08-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned A.P.P. for the State through video-conferencing. The petitioner has preferred this application for grant of regular bail in a case registered u/s 364A read with 34 of the Indian Penal Code.

As per the prosecution case, six unknown miscreants boarded on Scorpio came and abducted the son of the informant and demanded Rs. 70 lakh as ransom for releasing his son. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

The petitioner is not named in the F.I.R. and his name has sprung up during the course of investigation. No exchange of money took place between the parties. The petitioner is in custody since 24.08.2021 Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the mobile which used in the crime was recovered from the petitioner. Considering the aforesaid facts and circumstances, as well as the period of his detention, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Banka in connection with Sambhuganj P.S. Case No. 195 of 2021.

The application stands allowed.
