Petitioner seeks bail in Excise Case No.C-1-354/18 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
Accusation is that in course of checking while one Tata Max Sumo was intercepted by the Excise Officials of the State Government, driver of the vehicle Vikas Kumar succeeded in fleeing away but the petitioner Navnit Kumar was found sitting and on search 81 litres foreign liquor kept in cartuns in different bottles was recovered from the vehicle. Submission made on behalf of the learned counsel for the petitioner is that the petitioner boarded on the vehicle in the way and he had no knowledge about the liquor. He is in jail
Patna High Court Cr.Misc. No.71262 of 2018(22) dt.03-12-2018 2/2 custody since 27.09.2018 having no criminal antecedent. Learned A.P.P. opposed the prayer for bail of the petitioner.
Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judg-II-cum Special Judge Excise, Purnea, in Excise Case No.C-1-354 of 2018.
