JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-10-2015 Petitioner is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 323, 354 of the Indian Penal Code.
It is alleged that petitioner entered into the house of the complainant and made an attempt to outrage the modesty of the complainant.
It is submitted by learned counsel for the petitioner that petitioner happens to be brother-in-law of the complainant and for a petty dispute the accusation has been levelled. There is nothing on record to suggest that complainant was medically examined. Moreover for the occurrence of 13.05.2015, the complaint was filed on 15.05.2015.

Considering the nature of accusation and the relationship of the petitioner with the complainant, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Purnea in connection with Complaint Case No. 1595 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
