Mr. Sri Manoj Kumar - 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 04-12-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Bhawanipur P.S. Case No. 53/2018, instituted for offences under Sections 341, 323, 376/522, 307, 379, 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioners has submitted that there is general and omnibus allegation against these petitioners that they tried to misbehave with daughter-in-law of informant. It is alleged in the written report that on the date of occurrence daughter-in-law of informant was alone in her house as informant and his family members had gone to attend marriage. These petitioners entered into the house of informant

Patna High Court Cr.Misc. No.69950 of 2018(2) dt.04-12-2018 2/2 and attempted to misbehave with his daughter-in-law. Learned counsel for the petitioners has submitted that from the written report itself it appears that informant is not eyewitness. Both petitioners are full brothers. Petitioner no. 1 is a disabled man and petitioner no. 2 lives in Punjab. They have been falsely implicated in this case due to enmity. Petitioners are in custody since 03.08.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Purnia in connection with Bhawanipur P.S. Case No. 53/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners.
