In the present case this Court has directed for making demarcation of 50 decimals of land as the petitioner has claimed that he has right and title over the said land. While present matter was pending the petitioner was served notice dated 23.1.2015 whereby he was directed to remain present for the purposes of measurement and demarcation but he refused to take notice. It has been mentioned that land has been demarcated and no construction has been made over the land of the petitioner. In such view of the matter, no case is made out by the petitioner for initiation of contempt proceeding. However, the

Patna High Court MJC No.4742 of 2014 (3) dt.18-02-2015 petitioner, if so advised, may file a civil suit before court of competent jurisdiction for redressal of his grievance. Accordingly this application is dismissed.
