JUSTICE BIRENDRA KUMAR ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 47(a)(f) of the Bihar Excise (Amendment) Act, 2016.

From a hut, said to be of the petitioner, about 25 liters of country-made liquor was recovered on 31.01.2016. The petitioner is a female and has stated on oath that she has got no criminal antecedent and she was not present at the time of recovery.

Considering the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt

Patna High Court Cr.Misc. No.9427 of 2017 (2) dt.16-03-2017 2/2 of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/Successor Court in connection with C-2A/122/16, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, with condition that petitioner shall fully cooperate with the investigation and trial of the case.
