JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 This application has been filed for cancellation of anticipatory bail granted to opposite party Nos. 2 to 4 by learned Additional Sessions Judge-VII, Danapur, by order dated 6.9.2018 in ABP No. 5339 of 2018 in connection with Naubatpur P. S. Case No. 331 of 2018 registered under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code. The ground for cancellation of bail is that fardbeyan was recorded at PMCH and grievous fracture injury was found on the person of injured and there was also allegation of theft of gold chain and other articles but in spite of that opposite party Nos. 2 to 4 have been granted anticipatory bail.

Patna High Court CR. MISC. No.71617 of 2018(2) dt.24-02-2020 2/2 Heard learned APP and perused the impugned order from which it appears that learned Sessions Judge considering the ground that there was land dispute between the parties and also considering the fact that there was no injury report available on the record and even the fracture injury was on the hand, not on the vital part of the body, has granted bail and there is no case of misuse of bail or tampering with the evidence. Considering the above discussions, I find no merit in this application.

This application is, accordingly, dismissed.
