The petitioner apprehends his arrest in Pipra P.S. Case No. 150 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that while he was going to attend the Panchayati scheduled to be held at the house of Bouku Sah, the petitioner came there and assaulted him with Dabiya on his head. Other accused persons also assaulted him.
Learned counsel for the petitioner submits that there is a counter version and it is submitted that the informant and others committed dacoity in the house of the petitioner. During that course the informant got injuries but, from perusal of the case diary, it appears that the informant was sitting at the Darwaja of
Patna High Court Cr.Misc. No.11949 of 2017 (4) dt.23-05-2017 2/2 Bouku Sah where Panchayati was scheduled to be held and at the Darwaja of Bouku Sah the petitioner is alleged to have assaulted the informant with Dabiya on his head. One lacerated wound was found on the vertical part of the head of the informant. The nature of injury was kept reserved and the patient was advised for X-ray. Considering the facts aforesaid and the facts that the petitioner is alleged to have assaulted the informant with Dabiya on his head, while he was participating in Panchayati, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
