The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 386,387 and 379/34 of the Indian Penal Code.

Subsequently, section 411 IPC was also added. The accusation is of robbing Tata Sumo vehicle of the informant by five FIR named accused persons. The name of the petitioner sprang up in the confession of FIR named accused persons.

It is submitted by the learned counsel for the petitioners that there is specific case of the informant that

Patna High Court Cr.Misc. No.41890 of 2015 (2) dt.13-10-2015 2/3 five FIR named accused persons committed the offence. The FIR has been lodged against five persons and not against any unknown and except confession of the co accused, nothing has been collected during investigation. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Sultanganj P.S. Case No. 57 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bonds of the petitioners will be accepted on filing of an affidavit by the petitioners before the learned court below that they will regularly cooperate in the investigation. The said affidavits will be transmitted by the learned court below to the concerned I.O. Non cooperation in the investigation will give liberty to the prosecution to file application before the learned court
