The petitioner is languishing in custody in connection with Madhubani Town Police Station Case No. 365 of 2015 for offence punishable under Section 379 of the Indian Penal Code. The first information report relates to theft of motor cycle from the campus of Civil Court, Madhubani. The first information report is against unknown. The petitioner was abruptly arrested and his confessional statement was forcibly recorded.
The counsel for the petitioner has stated that nothing was recovered from the possession of the petitioner, he was not put on T.I.P and is in custody since 30th July 2016.
