None appears for respondent no.3 This writ application has been filed by the petitioner for a direction to the respondents to handover the part of land encroached by the private respondents for construction of apartment as per measurement report of Amin.

It appears that the petitioner is raising a private dispute in the writ application, which cannot be resolved in this proceeding.

Patna High Court CWJC No.22366 of 2013 dt.24-09-2015 2/2 However, in view of limited prayer made at the time of hearing that the petitioner has approached the Municipal Commissioner, Patna Municipal Corporation by filing a representation in the year 2013, but no decision has been taken as yet, the Municipal Commissioner is directed to dispose of the representation of the petitioner in accordance with law after granting reasonable opportunity to all the concerned persons within a period of three months from the date of receipt/production of a copy of this order, if the same has already not been disposed of. It is made clear that this Court has not formed or expressed any opinion with respect to the merit of the case. This writ applications stand disposed of.
