JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-09-2015 The matter has been listed out of turn since petitioner no.1 is suffering from heart ailment and has been referred to SGPGI, Lucknow for angiography, a supplementary affidavit to that effect has been filed.

The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504 and 307/34 of the Indian Penal Code.

The accusation is of making assault to the brother and father of the informant. One of the injuries of the informant's father has been found to be grievous though, other injuries have been found to be simple.

No.43343 of 2015 (2) dt.28-09-2015 2/2 It is submitted by learned counsel for the petitioners that for the petty dispute, the accusation has been levelled and the accusation of assault is omnibus and general. There is counter versions of the occurrence also. Several persons from petitioners' side also received injuries out of them one Sita Devi has received grievous injury.

Considering the above facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua in connection with Mohania P.S. Case No. 297 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
