JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-10-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Raghopur P. S. Case No. 103 of 2015 registered under Sections 341, 323, 324, 307, 379, 504, and 506/34 of the Indian Penal Code.

It is contended that there is a case and counter case in which members of both sides have sustained injuries. Injuries sustained by the members of the prosecution party are all simple in nature. It is further contended that the petitioners and the informant are agnates and there was a land dispute existing

Patna High Court Cr.Misc. No.42399 of 2015 (2) dt.12-10-2015 2/2 between the parties.

Learned counsel for the State has opposed the prayer for bail.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Shri Kumar Rishikesh, learned Judicial Magistrate, Birpur at Supaul in Raghopur P. S. Case No. 103 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
