JUSTICE ARVIND SRIVASTAVA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is an accused in Bihra P.S. Case No.132/16 registered under Sections 341, 323, 379, 494, 498A, 504, 34 of I.P.C. and Section 3⁄4 of D.P.Act. The accusation against the petitioner is of demand of dowry and on non-fulfillment of the demand of dowry, torturing and assaulting the informant, Mala Devi.

The submission of the petitioner is that after marriage the informant went to her naihar she never returned to her matrimonial home and after wait and watch the petitioner solemnized second marriage with another lady.Hence, he has been falsely implicated in this case.

Patna High Court Cr.Misc. No.53084 of 2016 (2) dt.21-12-2016 2/2 Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri S.K.Singh, J.M.Saharsa, in Bihra P.S.Case No.132/16.
