The petitioners are apprehending their arrest in connection with Chakand P.S. Case No. 16 of 2016, registered for offences punishable under sections 147, 148, 149, 353, 201 and 379 of the Indian Penal Code.

Allegation against the petitioners is that while the tractor of the petitioners was taken by the Chaukidar to the Police Station, they changed the engine of the tractor on the way and as such created obstruction in the official duty and case is under Section 353 IPC.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.13239 of 2017 (3) dt.20-04-2017 Having heard both sides and in view of the aforesaid facts, I am not inclined to grant anticipatory bail to the petitioners, however, the petitioners are directed to surrender before the learned court below within a period of six weeks and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is disposed of.
