JUSTICE SHIVAJI PANDEY ORAL ORDER 23-07-2020 Heard Mr. Bipin Bihari, counsel for the petitioner and Mr. Murlidhar, counsel for the State as well as Mr. Arbind Kumar Singh, counsel for the informant through Video Conferencing.

In this case, the petitioner is seeking anticipatory bail in connection with Complaint Case No. 741C/2017 registered for offence punishable under sections 420, 467, 471 and 120-B of the Indian Penal Code.

From the record it appears that large number of cases have been filed against the informant and he has also filed several cases against other.

Patna High Court CR. MISC. No.20885 of 2020(2) dt.23-07-2020 2/3 In nut shell, the allegation against the petitioner has been made that he has issued a false and fabricated certificate. Learned counsel for the petitioner submits that during investigation, the police has found that the allegation made against the petitioner to have issued a false and fabricated certificate, is not correct but the certificate is genuine. Considering the statement of the counsel for the petitioner, the petitioner is granted provisional bail and he, in the event of arrest or surrender before the court below within six weeks from today, is directed to be enlarged on provisional bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah in connection with Complaint Case No.

741C/2017 of 2019, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
