The petitioner in the present case is seeking pre-arrest bail in connection with Shakurabad P.S. Case No.- 112 of 2021 registered for the offences punishable under Sections 341, 323, 307, 304/34 of the Indian Penal Code. She has got no criminal antecedent.
Learned counsel for the petitioner submits that the petitioner along with one Bhimlesh Kumar assaulted the informant and his wife and due to that the wife of the informant died on the place of occurrence itself.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that there is no specific allegation of assault against the petitioner.
Patna High Court CR. MISC. No.28321 of 2023(2) dt.07-07-2023 2/2 Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.
Having regard to the facts and circumstances of the case, wherein the allegations of causing assault upon the informant and his wife by this petitioner and one Bhimlesh Kumar as a result of which the wife of the petitioner died, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Prayer is refused.
This application stands dismissed.
