=========================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL JUDGMENT Date: 23-06-2017 Inter alia contending that an order passed in the matter of appointment of petitioner as a Village Level Worker (Jan Sewak) passed on 08.05.2001 in CWJC No.9678 of 2000 has not been given effect to, the petitioner's case has not been considered as directed, this application in question has been filed for initiating action for contempt. While issuing notice, it was pointed out by this Court on 24.10.2003 that challenging the entire selection process issued for appointment on the post of Village Level Worker, two writ petitions have been filed before this Court which are pending considering before the Division Bench in CWJC No.1251 of 2003 and CWJC No.358 of

Patna High Court MJC No.2485 of 2001 dt.23-06-2017 2/2 2002 and, therefore, this Court directed listing of this contempt application after decision of the aforesaid two writ petitions. The records of the said writ petitions being CWJC No.1251 of 2003 and CWJC No.358 of 2002 have been received and a perusal of the same goes to show that the entire selection conducted to the post in question have been quashed by a Division Bench of this Court in the aforesaid two cases and it has been held that the entire selection stands vitiated and the direction was issued to conduct the selection process fresh.

In view of the aforesaid order passed by a Division Bench of this Court in CWJC No.1251 of 2003 and CWJC No.358 of 2002 by a Division Bench of this Court on 23rd November, 2006, now no further indulgence can be made and no direction can be issued for considering the case of the petitioner as entire selection process has been quashed by a Division Bench of this Court.

Accordingly, finding no indulgence to be made, the application stands dismissed.
