JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-04-2017 This application has been filed on behalf of the petitioner for modification in the order dated 06.03.2017 passed in Criminal Misc. No. 2546 of 2017 by this court with regard to rectify the name of husband of petitioner no. 3, Rubi Devi, as the name of her husband has inadvertently been typed as 'Papu Singh' in place of 'Birendra Singh' and also prays to extend the period of surrender of the petitioner in the court below. Learned counsel for the petitioner submits that by the order dated 06.03.2017 passed in Criminal Misc. No. 2546 of 2017, all the petitioners including petitioner no. 3, Rubi Devi have been enlarged anticipatory bail, in the event of their arrest or surrender before the learned court below within a period of six weeks from that day but the petitioner no. 3, Rubi Devi, could not

Patna High Court Cr.Misc. No.19543 of 2017 (2) dt.26-04-2017 surrender within the stipulated period because the name of her husband has wrongly been mentioned in the petition as 'Papu Singh' in place of 'Birendra Singh'. In that view of the matter, the name of husband of the petitioner no. 3, Rubi Devi, may kindly be corrected as Birendra Singh and to extend the period of surrender of the petitioner in the court below.

Considering the submission of the learned counsel for the petitioner, the period of surrender of the petitioner, in connection with the aforesaid case, in the court below is further extended for three weeks from today and the name of husband of petitioner no.3 is corrected as 'Birendra Singh' in place of 'Pappu Singh'. Accordingly, this application is allowed with the aforesaid modification in the order dated order dated 06.03.2017 passed in Criminal Misc. No. 2546 of 2017.
