NILU AGRAWAL ORAL ORDER 28-11-2016 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is languishing in custody since 22.07.2016 in connection with Sangrampur P.S. Case No. 73/16 for offences punishable under Section 392 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that while he was returning home, his motorcycle was snatched by four miscreants.

It has been submitted by the learned counsel for the petitioner that he is innocent and has falsely been implicated in the aforesaid case. He submits that nothing has been recovered from his possession, rather the motorcycle has been recovered from the possession of one Satyendra Ram. He further submits

Patna High Court Cr.Misc. No.51079 of 2016 (2) dt.28-11-2016 2/2 that no Test Identification Parade has been done so far and he has no criminal history.

However, learned APP for the State submits that though the petitioner is not named in the First Information Report, but during investigation his name surfaced, hence, opposes the prayer for bail.

Considering the facts and circumstances and the period of custody, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, in connection with Sangrampur P.S. Case No. 73/16.
