The petitioner seeks bail in connection with Dev P.S. Case No. 99 of 2018 instituted for the offence under Section(s) 304/34 of the Indian Penal Code.
In the written report, it is alleged that son of the informant was student of class nursery. He has fallen from roof in the school on account of which he sustained injury. It is further alleged that petitioner was the owner of the school. He did not provide vehicle on time to take the son of informant to hospital.
In the written report there is no allegation of committing any specific overt act against the petitioner. Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.69955 of 2018(2) dt.30-11-2018 2/2 Barsha Kumari @ Barsha Bharti @ Kumari who was the headmistress of the school has already been granted regular bail by this Court by order dated 28.11.2018 passed in Cr. Misc. no. 69721 of 2018.
Petitioner is in custody since 27.8.2018 having clean antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Dev P.S. Case No. 99 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner.
