====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 07-11-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 366(A) and 34 of the Indian Penal Code.

The informant alleges that on 22.04.2017 at 10:00 am, his minor daughter Kajal Kumari was lured by Raju Kumar with an intention to marry, further, the parents of Raju also helped them in eloping.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that the victim statement was recorded under Section 164 of CrPC wherein she has not supported the prosecution case rather has

No.22402 of 2022(2) dt.07-11-2022 2/2 stated that she has married the petitioner and out of the wedlock, two children were born and when she came to know about his false case, she came to gave her statement. Learned counsel further submits that the victim in her statement recorded under Section 164 has disclosed her age as 23 years. Learned A.P.P., Gulnar Begum, for the State opposes the prayer for anticipatory bail of the petitioner. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Silao P.S. Case No. 106 of 2017 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
