The petitioner is accused in connection with Dumraon P.S. Case No. 59 of 2016 registered under sections 457/380 of the I.P.C. and later on, section 411 of the I.P.C. was added pending in the Court of C.J.M., Buxar.

The accusation is of recovery of one single barrel gun and several articles.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case on the confessional statement of co-accused. It is also submitted that petitioner is in custody since 19.10.2016 Learned A.P.P. appearing on behalf of the State

Patna High Court Cr.Misc. No.53788 of 2016 (3) dt.16-01-2017 2/2 submits that the said weapon has been recovered from the house of the petitioner Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.

However, petitioner may renew his prayer for bail after framing of charge.
