JUSTICE SANJAY PRIYA ORAL ORDER 21-04-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Complaint Case No. C-673 of 2015 instituted for the offence under Sections498A/379 of the Indian Penal Code. The petitioner is husband of the informant. There is allegation against him that he committed mental and physical torture with the complainant for demand of motorcycle and on non-fulfillment of aforesaid demand and on the ground of issueless, she was ousted from her sasural.
It is apparent that the marriage took place on 29-022004. The matter was sent to mediation centre on 10-02-2017 with consent of the parties.
The report of mediator was received. The copy of the report is kept at flag "A". It has been mentioned that the petitioner
Patna High Court Cr.Misc. No.3612 of 2017 (3) dt.21-04-2017 2/2 never appeared before the Mediation Centre.
In such circumstances, there is specific allegation against this petitioner and from the conduct of the petitioner; it appears that he is not ready to restore conjugal relationship with the complainant.
Therefore, prayer for anticipatory bail of the petitioner is rejected.
The petitioner is directed to surrender in the court below and will pray for regular bail, which will be considered by the court below on its own merit without being prejudiced by this order.
