JUSTICE SANJAY PRIYA ORAL ORDER 03-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Alamnagar (Ratwara O.P.) P.S. Case No. 21 of 2018 instituted for the offence under Sections 302 and 120(B) of the Indian Penal Code. Counsel for the petitioner submits that petitioner is not named in the written report. The informant has taken the name of this petitioner after lapse of about 2 months before the police in his further statement as recorded in paragraph-8 of the original case diary. Thereafter, other witnesses have also taken the name of this petitioner.

In such circumstances, mere suspicion has been raised against the petitioner. Co-accused Santosh Kumar Singh has already been granted bail by coordinate Bench of this Court vide order dated 6.10.2018 passed in Cr. Misc. 52635 of

Patna High Court Cr.Misc. No.69383 of 2018(2) dt.03-12-2018 2/2 2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Udakishunganj, Madhepura, in connection with Alamnagar (Ratwara O.P.) P.S. Case No. 21 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
