2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 380, 457 of the Indian Penal Code.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely implicated in the instant case during the course of investigation. It is next submitted that F.I.R. was instituted against unknown with an allegation of theft and police during the course of investigation arrested one Dhiraj, who in his confessional statement disclosed the name of the petitioner as his accomplice in committing the occurrence. Learned counsel submits that the petitioner does not know Dhiraj and works as a labour outside Bihar and he was not even present at the place of occurrence. It is further submitted that petitioner will not abscond rather will cooperate in the investigation.

4. Learned A.P.P. opposes the bail application.

5. Consideration the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below withing a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Vaishali, Hajipur, in connection with Jandaha P.S. Case No.300 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

6. However, in the event, if the Investigating Officer of the case file an application before the learned trial Court bringing to the notice that the petitioner, despite giving assurances to this Court, is not cooperating in the investigation, in that event, the learned trial Court shall be at liberty to cancel the bail-bond of the petitioner.

7. Let a copy be sent to the concerned Police Station through learned trial Court.

8. The applications stands allowed.
