The petitioner seeks quashing of the order of cognizance dated 11.9.2012 passed by the Judicial Magistrate 1st Class, Vaishali at Hazipur in Complaint Case No. 959 of 2012. The case of the complainant is that he had applied for self employment scheme in the Industry Department which had been approved and forwarded to the petitioner. However, when he asked the petitioner with regard to sanction of the amount he demanded 10 per cent bribe and also assaulted him.

From the petition filed herein it appears that the petitioner had followed the rules which govern the grant of loan under such scheme the complainant did not qualify but he insisted on petition passing the loan and therefore, instituted the present false complaint.

Patna High Court Cr.Misc. No.3838 of 2013 dt.25-04-2016 Notices had been issued to the Opposite Party no. 2 but none appears on her behalf.

Having considered the facts of the case, the application is allowed and the order of cognizance dated 11.9.2012 passed by the Judicial Magistrate 1st Class, Vaishali at Hazipur in Complaint Case No. 959 of 2012 is hereby set aside.
