The petitioner apprehends his arrest in connection with K. Hat (Sahayak) P.S. Case No. 268 of 2015 registered under Sections 232, 307, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act pending in the court of Chief Judicial Magistrate, Purnea.
The accusation is that four persons named in the F.I.R. including the petitioner reached in the cricket field on two motorcycles, where Jain Raja and Samar Raja made indiscriminate firing three to four occasions at the informant, Sah Ali Haue, fortunately, he saved himself. At that time, this petitioner and one
Patna High Court Cr.Misc. No.43466 of 2015 (2) dt.14-10-2015 Fahad Raja were driving the motorcycles.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to him. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within six weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
