This application for regular bail arises out of Kurtha P.S. Case No. 128 of 2019, disclosing offences punishable under Sections 341, 323, 324, 307, 504, 379 and 34 of the Indian Penal Code.
It is the case of the prosecution that the petitioner and other two named co-accused persons viz. Dilip Dom and Suraj Dom assaulted the informant's son and injured him with knife. Learned counsel appearing on behalf of the petitioner has drawn my attention to Annexure-2 of this application, and has submitted that one Upendra Dom had got registered an F.I.R. against the informant, as SC/ST P.S. Arwal Case No. 17 of 2019, making allegation of attempt to outraged the modesty
Patna High Court CR. MISC. No.21285 of 2020(2) dt.01-07-2020 2/2 of her daughter and assaulting him and his son. He contends that the present F.I.R. is out of vengeance. He has further submitted that there is no allegation against the petitioner of having given any dagger blow.
Considering the above submission and that fact that the petitioner is in custody since 22.11.2019, this application is allowed.
Let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Kurtha P.S. Case No. 128 of 2019.
