JUSTICE SUDHIR SINGH ORAL ORDER 08-05-2015 The petitioner is apprehending his arrest in connection with Dariyapur P.S.Cas No. 227 of 2014 instituted under Sections 147, 148, 149, 341, 323, 307 and 504 of the Indian Penal Code. Heard learned counsel for the petitioner and the State. The allegation in the FIR is that all the accused persons surrounded the informant having lathi, danda and knife in their hands and accused Ashok Singh gave knife blow causing injury on his heads. Others assaulted him with lathi and danda. It has been submitted on behalf of the petitioner that as far petitioner is said to have caused injury upon the head of the informant, from perusal of the injury report of the informant, which is Annexure 3 to the present application, it would appear that the injury found by the doctor is said to have caused by hard

It is further submitted that there is a counter case also and the said counter case is Annexure 2 to the present application. Further my attention has been drawn to Annexure 4, which indicates that the petitioner's side has also sustained injury. It is also submitted that the petitioner has no criminal antecedent. On behalf of the State, it has been submitted that the petitioner is named in the FIR and specific allegation has been made against him.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Saran,Chaprain connection with Dariyapur P.S.Case No. 227 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
