Petitioner is in custody in connection with Vibhutipur P.S. Case No. 58 of 2020 for the offence under sections 272. 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
In the instant case total 147.750 liters of foreign liquor was seized from the family joint house of the petitioner. The petitioner is in custody since 11.3.2020. Considering the fact that petitioner has no criminal antecedent and liquor was not seized from the conscious possession of the petitioner, the Court is inclined to grant bail
Patna High Court CR. MISC. No.21114 of 2020(2) dt.29-06-2020 2/2 to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Samastipur, in connection with Vibhutipur P.S. Case No. 58 of 2020 subject to the condition that on release the petitioner shall render his service as volunteer in dedicated Covid-19 hospital for a period of one month. He is required to report to the district Nodal Officer who shall utilize the service of the petitioner appropriately.
