The petitioner seeks pre-arrest bail in connection with Hasanpur P. S. Case No. 99 of 2015 registered under Sections 304-B and 201/34 of the Indian Penal Code.
It is contended that it would be evident from perusal of the FIR itself that the petitioner is not related in any manner to the husband of the deceased. He being a co-villager of the husband of the deceased cannot be prosecuted at least for the offence punishable under Section 304-B of the Indian Penal Code. Learned counsel for the State does not dispute the contention that the petitioner is not related to the husband of the
Patna High Court Cr.Misc. No.42407 of 2015 (2) dt.12-10-2015 2/2 deceased in any manner.
Taking into consideration the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri D. K. Bhaskar, learned Judicial Magistrate, 1st Class, Rosera (Samastipur) in Hasanpur P. S.
