The petitioner is apprehending his arrest in connection with Nagar Bettiah P.S.Case No.841 of 2018 dated 28.9.2018 registered for offences punishable under Sections 406 and 420 of the Indian Penal Code.

Allegation against the petitioner as per FIR is that the petitoner demanded ATM Card from the informant as he is need of money and in good faith, the informant gave his ATM Card and later on he came to know that there was transaction of Rs.3,16,700/- and the account was also closed. Submission of the learned counsel for the petitioner is that he has brought that money for the treatment of his mother and he has not defalcated any money.

Patna High Court CR. MISC. No.19482 of 2019(3) dt.13-05-2019 2/2 Heard learned A.P.P. has submitted that the materials collected during the investigation clearly discloses that the card was used for some illegal transaction and that is why the Account of the informant was closed. .

Having heard both sides and in view of allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may move for regular bail, which will be considered on its own merit without being prejudiced by the order of this Court.

With the aforesaid direction, this application is dismissed.
