While informant Ragho Sharma along with Ravindra Pandey (deceased) were returning after attending feast and reached near house of Tapeshwar Singh of village Kalen, it has been alleged that Mritunjay Sharma, Chunnu Sharma, Sanjay Sharma, Dhiraj Sharma (petitioner), Purshottam Sharma armed variously intercepted them and began to assault. During course thereof, Mritunjay Sharma and Sanjay Sharma, who were armed with iron rod brutally assaulted Ravindra Pandey. He along with Sunil Sharma and Mohan Pandey tried to rescue were also assaulted by Danda.

Patna High Court Cr.Misc. No.48990 of 2016 (02) dt.15-12-2016 be the assailant of deceased, co-accused Munna Sharma had been granted regular bail under Cr. Misc. No.26909 of 2016 vide order dated 29.08.2016 as well as Chunnu Sharma under Cr. Misc. No.37579 of 2016 vide order dated 09.09.2016 (Annexure-3 series).
Accordingly, petitioner, Dhiraj Sharma is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Khudwan P.
