JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-10-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,389,120B,341,323,353,431 and 504 of the Indian Penal Code.
The prosecution case is that in the night of 20.3.2015 some unknown miscreants committed theft by breaking shutters of the shops of Raghopur market. The police came and started conducting raid at suspicious places but in protest the mob blocked NH106, obstructed the traffic and started abusing and assaulting the police personnel. The mob put the burning tyres on
Patna High Court Cr.Misc. No.42946 of 2015 (2) dt.14-10-2015 2/2 road.
It is submitted by the learned counsel for the petitioners that the mob was protesting against the inaction of the police due to which theft was committed and the police in order to save their skin, lodged the present case. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the accusation against the mob, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM, Birpur, Supaul in connection with Raghopur P.S. Case No.45 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
