JUSTICE RAVI RANJAN ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under Sections 458, 380, 401, and 411 of the Indian Penal Code and Section 47(a) of the Bihar Excise (Amendment) Act, 2016.
It is contended on behalf of the petitioner that he is not named in the First Information Report and he has been made accused on the basis of disclosure made by apprehended coaccused persons, namely, Pankaj Sahni, Dilip Sahni and Ajay Sahni and allegedly, on his disclosure, theft articles were recovered from Devi Lal Sahni and Anil Sahni. It is further contended that Anil Sahni has been granted bail by a Co-ordinate Bench of this Court vide order dated 5.10.2016 passed in Cr. Misc.
Patna High Court Cr.Misc. No.42710 of 2016 (2) dt.06-10-2016 2/2 No. 43286/2016. It is also contended that petitioner is in custody since 18.6.2016 and having clean antecedents. Having regards to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in Mushhari P.S. Case No. 80/ of 2016.
If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds. (Dr. Ravi Ranjan, J) Spd/- U T
