03-12-2018 Heard Sri Pankaj Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 16-09-2018, as stated in paragraph - 10 of the petition, with clean antecedent, as stated in paragraph - 3 of the petition, has prayed for grant of bail in Kalyanpur P.S. Case No. 152 of 2018 registered for offence under Sections 30(a), 47 of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has falsely been made accused on an accusation of recovery of 21 litres of Indian make foreign liquor from cattleshed of the petitioner. It has been argued that the cattle-shed was open and petitioner was not aware regarding such liquor.

No.70438 of 2018(2) dt.03-12-2018 2/2 Be that as it may, considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Jay Kishun Sah @ Budha Sah be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional District & Sessions Judge-cum-Special Judge (Excise Act), Samastipur in connection with Kalyanpur P.S. Case No. 152 of 2018.
