The petitioner seeks bail in Case No.C-65(7) of 2016/Special Case No.8 of 2016 instituted for the offence under Section 20(b) of the N.D.P.S. Act.

It is alleged that 3 kgs, 200 gms Ganja was recovered from the shop of the petitioner. It is mentioned in paragraph 3 of the petition that the petitioner has no criminal antecedent. The petitioner is said to be in judicial custody since 21.07.2016. In such circumstances, keeping in view the clean antecedent of the petitioner and period spent by him in custody, prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.45155 of 2016 (5) dt.01-03-2017 Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Madhepura in connection with C-65(7) of 2016 of Udakishunganj Police Station/Special Case No.8 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. The petitioner shall remain present in the trial and will not influence the witnesses in any manner or delay the trial and his absence on two subsequent dates in the court below will amount to cancellation of bail bond.
