In the present case, the petitioner is making a prayer for restoration of Cr. Misc. No. 85546 of 2019 which stood dismissed for default for non-compliance of the order dated 11.2.2020.
This Court finds that this Court, vide order dated 11.2.2020, had directed the petitioner to take steps for service of notice upon the opposite party no.2 within a period of two weeks but, he has taken steps on 26.2.2020 in stead of 25.2.2020 and, thus, there is a delay of one day due to the illness of the advocate clerk.
