JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 15-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State as also the learned counsel for the informant/opposite party no.2. The petitioner is apprehending his arrest in Mahila P.S. Case No.67 of 2016 registered for the offence under Sections 342, 323, 307, 498A and 504/34 of the Indian Penal Code besides Sections 3/4 of the Domestic Violence Act.

The accusation is of torturing and causing assault to the informant/opposite party no.2 by her husband (petitioner) and other in-laws for non fulfillment of the dowry demand and also ousting the informant/opposite party no.2 from her matrimonial

Learned counsel appearing on behalf of the petitioner submits that, admittedly, the petitioner is the husband of the informant/opposite party no.2. Further submission is on 10.02.2017 order was passed by a Bench of this Court for issuing the notice to the opposite party no.2 with direction to not take coercive steps against the petitioner. Later on the prayer of the petitioner vide order dated 18.04.2017 passed by this Court, , the case was directed to be listed after two weeks. In the meantime, the petitioner approached the informant/opposite party no.2 to take her at the matrimonial house but she refused. The petitioner is still ready to keep his wife (informant/opposite party no.2) with full honour and dignity.

Learned counsel for the informant/opposite party no.2 submits that the petitioner had come in parental house of the informant O.P.No.2 but he did not properly approached for taking her to the matrimonial house.

Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on l bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M.,
