JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 387 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act. Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that according to the allegation, petitioner has fired against the informant but the injury is only abrasion and nothing else. It has also been submitted that petitioner has demanded Rs.50,000/- from the informant but that allegation has been levelled due to the fact that the dispute arose in the marriage of the petitioner and because of that petitioner has falsely been implicated in the present case.

Having heard both sides, in view of the fact that there
Patna High Court Cr.Misc. No.7479 of 2017 (2) dt.22-02-2017 2/2 is demand from the informant and thereafter firing was made in this case, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.
However, petitioner is directed to surrender in the court below, i.e., learned Addl. Chief Judicial Magistrate, Sheohar, in connection with Tariyani P. S. Case no. 97 of 2016 and make prayer for regular bail which will be considered by the court below itself on its own merit without being prejudiced by the order of this Court.
