The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 302 and 201 of the Indian Penal Code and Section 27 of the Arms Act pending in the learned court below.
On 09.11.2014, the informant along with other police personnel was on patrolling. When they reached near overbridge of G.T. Road, they saw a person lying there. On inspection, the said person was found dead with three hole injuries on the body. A pellet was also found on the back side of the dead person. Pellet was seized and seizure list was prepared
Patna High Court CR. MISC. No.24318 of 2023(2) dt.07-07-2023 2/3 thereafter the dead body was sent to Sadar Hospital, Aurangabad for post mortem examination. According to the informant, the person was shot dead somewhere else and was thrown there with an intention to conceal the crime and thus the FIR has been registered against unknown.
Learned senior counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. He submits that the F.I.R. has been lodged against unknown hence petitioner is not named in the F.I.R. He further submits that after investigation the police has filed final form against the petitioner but the learned Court below differed the final form and taken cognizance against the petitioners. He submits that Petitioner no.1 has got no criminal antecedent and petitioner no.2 has got one criminal antecedent as stated in para-3 of the bail application.
Learned APP for the State opposes for prayer for bail. Considering the aforesaid facts and circumstances, let the petitioners, named above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail, on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the
