JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner, who is Devar of the deceased, is in custody in connection with Ara Nawada P.S. Case No. 355 of 2019 for the offence under Section 304(B)/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner would submit that the deceased received burn injury due to accident during cooking food and died during course of treatment. He further submits that the husband of the deceased has been granted bail by coordinate Bench of this Court vide order dated 17.08.2020 passed in Cr. Misc. 9091 of 2020. Considering the fact that the petitioner is Devar of the

No.20407 of 2020(5) dt.02-11-2020 2/2 deceased and husband of the deceased Deepak Kumar has been granted bail in a case where the deceased died during course of treatment at PMCH, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S.
