JUSTICE SUDHIR SINGH ORAL ORDER 08-05-2015 The petitioner is apprehending his arrest in connection with Bhorey P.S.Case No. 32/2014 instituted under Sections 323, 341, 406 and 498(A) of the Indian Penal Code and Section 3 / 4 of D.P.Act.
Heard learned counsel for the petitioner and the State. The prosecution case, in brief, is that informant Sajani Devi was married to the petitioner. It is alleged that for want of dowry in the shape of motorcycle, the victim was used to be subjected to various sort of torture and cruelty. It is further alleged the accused persons kicked the victim from her matrimonial home after assaulting her.
Learned counsel for the petitioner has submitted that he is ready to keep the informant as his wife with full dignity and
Patna High Court Cr.Misc. No.49933 of 2014 (2) dt.08-05-2015 2/2 honour but she is not ready to stay with the petitioner. It is further submitted that the petitioner has no criminal antecedent. On behalf of the State, it has been submitted that the petitioner is named in the FIR and specific allegation has been made against him.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Bhorey P.S.Case No. 32 of 2014 , subject to the conditions as laid down u/s 438(2) Cr.P.C. The petitioner is directed to deposit an amount of Rs. 1500/- (fifteen hundred) every month in the court below which shall be released in favour of the informant. (Sudhir Singh, J) singh/- U T
