JUSTICE BIRENDRA KUMAR ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

A stolen motorcycle was recovered from the possession of co-accused who confessed before the police that the petitioner was the person who had fled away from there and was his criminal associates. Petitioner has stated on oath that he has got no criminal antecedent and nothing has been recovered from his possession.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the

Patna High Court Cr.Misc. No.13800 of 2017 (2) dt.30-03-2017 court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Siwan/Successor Court in connection with Bhagwanpur Hat P.S. Case No.169 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
