====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-07-2022 Heard learned counsel for the petitioners and the State.

Petitioners apprehend their arrest in a case registered for the offence punishable under Section 30a of the Bihar Prohibition and Excise Act sections 272 and 273 of the IPC . As per the prosecution case, 53.100 Nepali Saufi Wine was recovered from the house of co-accused. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioners and they are no way connected with the aforesaid recovery.

Patna High Court CR. MISC. No.22762 of 2022(2) dt.29-07-2022 2/2 Learned counsel for the State submits that Petitioners have got no criminal antecedent of similar nature. Considering the nature of the allegation, prayer for bail of the petitioners is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without being prejudiced by this order.
