The petitioner is accused in connection with Ujirpur P.S. Case No. 211 of 2013 registered under Section 392 of the Indian Penal Code pending in the Court of Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that petitioner himself admitted in para 59 of the case diary that he was a member of the gang.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is

Patna High Court Cr.Misc. No.49872 of 2016 (3) dt.09-02-2017 2/2 rejected.

However, petitioner may renew his prayer for bail after framing of charge.
